Welcome to Thaistayandfly. By using our services, you agree to the following Terms of Service. Please read them carefully before proceeding.

1. Nature of Service

Thaistayandfly is a personal travel planning and coordination service operated by an independent travel consultant based in Thailand. Our service includes:

• Building a personalized, day-by-day trip itinerary tailored to your needs and budget.
• Making bookings on your behalf (hotels, internal flights, transfers) through third-party platforms (e.g., Agoda, Booking.com) or directly with local providers.
• Real-time WhatsApp support throughout your trip for questions, changes, and emergencies.

Thaistayandfly is NOT a licensed travel agency and does not sell packaged tours. We act as a personal travel consultant and booking coordinator.

2. Fees & Payment

2.1 Planning Fee

Our fee covers planning, research, itinerary building, booking coordination, and WhatsApp support throughout your trip. The planning fee is agreed upon before work begins and is due before the itinerary is sent.

2.2 Accommodation & Transport Costs

All hotel, flight, and transportation costs are paid directly to the provider using your credit card or payment method. Thaistayandfly does NOT collect or hold funds for accommodation or transport on your behalf.

2.3 Non-Refundable Fee

The planning fee is non-refundable once the detailed itinerary has been delivered to you. If you cancel before receiving the itinerary, a partial refund may be considered at our discretion.

3. Booking Authorization

By requesting that Thaistayandfly make bookings on your behalf, you explicitly authorize us to:

• Use the payment details you provide to complete reservations with third-party providers.
• Confirm bookings, select room types, and arrange transfers as discussed and agreed upon.

You are responsible for ensuring the accuracy of all personal details provided (full name as per passport, date of birth, travel dates). Thaistayandfly is not liable for errors arising from incorrect information supplied by you. You acknowledge that you have reviewed and confirmed all booking details before final payment is processed.

4. Third-Party Providers

Thaistayandfly uses third-party platforms (Agoda, Booking.com, local providers, etc.) to make reservations. All bookings are subject to the cancellation, amendment, and refund policies of the individual provider.

In the event of a dispute with a provider, we will assist you in communicating with the provider. However, Thaistayandfly is not a party to the contract between you and the provider and cannot guarantee refunds or resolutions.

5. Cancellation & Changes

5.1 Cancellation of Bookings

Any cancellation of hotels, flights, or transfers is subject to the cancellation policy of the specific provider. Refunds, if applicable, are returned directly to your payment method by the provider. Thaistayandfly is not responsible for refunds issued by third parties.

5.2 Changes to Itinerary

Itinerary changes requested before departure will be accommodated where possible. Changes requested during the trip are handled on a best-effort basis via WhatsApp. Additional fees may apply for significant re-planning.

5.3 Thaistayandfly's Right to Cancel

In exceptional circumstances (force majeure, health emergency, or circumstances beyond our control), Thaistayandfly reserves the right to suspend service. In such cases, the planning fee will be refunded on a pro-rata basis for work not yet completed.

6. Data Privacy & Security

By using our service, you consent to sharing personal information necessary to complete bookings, including:

• Full name (as per passport)
• Passport number and expiry date
• Date of birth
• Payment card details (used only for bookings on your behalf)

Thaistayandfly treats all personal data with strict confidentiality. We do not store credit card details after the booking is completed, and we do not share your personal information with third parties beyond what is required to complete your reservations. All communication is conducted via WhatsApp. By engaging our services, you consent to receiving trip-related communications via this channel.

7. Liability

Thaistayandfly acts solely as a travel planning consultant and booking coordinator. We are not liable for:

• Service quality, delays, cancellations, or failures by hotels, airlines, or transport providers.
• Loss of property, personal injury, or illness during your trip.
• Disruptions caused by force majeure events (natural disasters, political unrest, pandemics, government restrictions, strikes, or other events beyond our control).
• Failure to obtain required visas, travel documents, or vaccinations - this remains the traveler's sole responsibility.

Our maximum liability to you in any circumstances is limited to the planning fee paid to Thaistayandfly.

8. Traveler Responsibilities

• Ensure your passport is valid for at least 6 months beyond your travel dates.
• Check and obtain any required visas prior to departure.
• Purchase comprehensive travel insurance (strongly recommended).
• Review and understand the cancellation policies of all bookings before confirming.
• Inform Thaistayandfly of any special requirements (dietary, medical, accessibility).

9. Dispute Resolution

These Terms are governed by the laws of Thailand, where Thaistayandfly operates. Any disputes shall first be attempted to be resolved amicably via direct communication. If unresolved, disputes may be referred to the relevant consumer protection body in your country of residence.

10. Amendments

Thaistayandfly reserves the right to update these Terms at any time. The version in effect at the time of your booking confirmation applies to your trip.
